1. Introduction

Welcome to MoreMakeApps (the "Marketplace"). These Terms of Service ("ToS") govern your use of our website, applications, and any related services (collectively, the "Services"). By accessing or using the Marketplace, you agree to be bound by these ToS.

2. Definitions

  • Marketplace: The platform where users can purchase or access apps created by Callinetic.
  • Apps: Software connectors developed by Callinetic that connect to various platforms via API and are available for use on Make.
  • User: Any individual or entity using the Services, including buyers and users of the Apps.
  • Developer: Callinetic, the creator of the Apps available on the Marketplace.
  • Platform: The external services or software with which the Apps connect.
  • Make: The third-party service where the Apps are intended to be used.

3. Acceptance of Terms

By accessing or using the Services, you agree to comply with and be legally bound by these ToS and our Privacy Policy. If you do not agree with any part of these ToS, you must not use the Services.

4. Use of the Services

4.1 Eligibility

You must be at least 18 years old and capable of entering into legally binding agreements to use the Services.

4.2 Account Registration

To access certain features of the Marketplace, you may need to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

4.3 User Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

5. App Purchases and Licensing

5.1 Free and Paid Apps

The Marketplace offers both free and paid Apps. By purchasing or accessing an App, you acquire a non-exclusive, non-transferable license to use the App in accordance with these ToS.

5.2 Payments

All payments for paid Apps are processed through Stripe, a secure payment gateway. By providing payment information, you represent and warrant that you have the legal right to use the payment method provided.

5.3 Installation Process

After purchasing or accessing a free App, you will receive an invitation link to install the App into your Make account. The installation process is conducted on Make's platform, and you agree to follow any instructions provided.

5.4 Refunds

All sales of Apps are final. We do not offer refunds for any Apps purchased through the Marketplace, except as required by law.

6. Developer Responsibilities and Disclaimers

6.1 Best Practices

All Apps are developed according to industry best practices by a certified app developer. However, we do not guarantee that the Apps will be error-free or uninterrupted.

6.2 Independence

As an independent developer, Callinetic is not responsible for any issues arising from the use of the Platform or Make. The Apps are provided "as is," without warranties of any kind.

6.3 Liability

We shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Apps or the Marketplace, including but not limited to damages for loss of profits, data, or other intangibles.

7. User Conduct

You agree not to use the Services to:

  • Violate any local, state, national, or international law.
  • Infringe on the intellectual property or other rights of third parties.
  • Transmit any harmful or malicious software.
  • Engage in any conduct that restricts or inhibits any other user from using or enjoying the Services.

8. Intellectual Property

All intellectual property rights in the Marketplace and the Apps are owned by Callinetic or its licensors. You may not use, copy, modify, or distribute any part of the Services without our prior written consent.

9. Termination

We reserve the right to terminate or suspend your access to the Services, with or without notice, for any reason, including but not limited to a breach of these ToS. In most cases, we will provide prior notice to you before termination or suspension, except where immediate termination or suspension is warranted due to severe breaches or illegal activities.

10. Governing Law

These ToS shall be governed by and construed in accordance with the laws of Belgium, without regard to its conflict of law principles.

11. Changes to the Terms

We reserve the right to modify these ToS at any time. We will notify you of any changes by posting the new ToS on the Marketplace. Your continued use of the Services following such changes will constitute your acceptance of the revised ToS.

15. Entire Agreement

These ToS constitute the entire agreement between you and Callinetic BVBA regarding the use of the Services and supersede any prior agreements or understandings.

16. Waiver

No waiver of any term of these ToS shall be deemed a further or continuing waiver of such term or any other term, and Callinetic's failure to assert any right or provision under these ToS shall not constitute a waiver of such right or provision.

17. Assignment

You may not assign or transfer these ToS, by operation of law or otherwise, without Callinetic's prior written consent. Any attempt by you to assign or transfer these ToS, without such consent, will be null and of no effect. Callinetic may assign or transfer these ToS, at its sole discretion, without restriction.
